Family of child who suffered birth injuries awarded $55 million

In what may be the biggest monetary awards to a sole plaintiff in our nation's history, a family has been awarded $55 million for birth injuries suffered by their son. The case was brought against a doctor and hospital for medical malpractice. The hospital and the doctor were each deemed to be 50 percent responsible for the incident. The trial lasted for two weeks.

According to the plaintiffs, their son suffered from a lack of oxygen during his birth that led to numerous injuries including severe developmental delays and cerebral palsy. The child's head became stuck during delivery and his mother started hemorrhaging. The plaintiffs claim that the doctor ignored warning signs and failed to deliver the child, who is now age 4, via Caesarean section. The $55 million award may be capped via a prior agreement made between the parties.

Birth injuries are tragic situations.
