Man wins Walmart lawsuit when injury results in deformity

What can seem like a simple accident can sometimes result in a serious injury, even here in Maryland. A serious injury can rack up thousands of dollars in medical expenses and lead to years of pain and suffering. When such an accident occurs sometimes the only way to receive adequate compensation for a severe injury is to pursue an action in court.

Recently, a man won almost 1.3 million dollars in a premises liability lawsuit after slipping on a fallen sign in Walmart. The accident occurred when the man was walking down a grocery isle, turned the corner and slipped on a Gatorade sign. The man slipped and fell in a way that caused serious injury to his elbow and arm. When the man fell he tore his right bicep tendon, resulting in a life-long condition where his tendon bulges from his arm. The problem is known as "popeye" deformity. The deformity causes the man to have a permanently bulging bicep.

The deformity is a serious condition. The man suffered more than $200,000 in medical bills, lost wages and pain and suffering. The jury was sympathetic to the man's plight and he was awarded twice what his attorney requested.

Slip and fall accidents like this can occur in many places in Maryland - malls, grocery stores, parking lots and even large retailers like Walmart. Property owners have a duty to keep the premises safe for visitors, particularly from hazardous conditions such as a wet floor. While not all accidents will result in the same injury as the man suffered in this case, many can lead to high medical bills and long recover times. In such cases, filing a personal injury lawsuit can be a great option to recover costs and avoid suffering financially in addition to the physical injury.
