Wrongful death lawsuit filed for fatal accident

A mother, and grandmother who lost her child and grandchild due to an alleged drunk driver losing control of his vehicle, has decided to file a lawsuit to hold that driver accountable for his actions.

The wrongful death lawsuit was filed earlier this month, and is related to a February car accident that killed a 20-year-old woman and her 10-month-old baby. The lawsuit claims that due to another driver's negligence and decision to drive drunk, these two people were killed.

According to the lawsuit, the 40-year-old driver had lost control of his vehicle, went across a grassy median, up an embankment and then was airborne before landing his vehicle on top of the one being driven by the now deceased 20-year-old. At the time of the accident, the 40-year-old had a blood alcohol level of 0.2, which is more than two times the legal limit.

The mother and grandmother of the two accident victims, is seeking a total of $1 million for both of the deaths, and $600,000 in punitive damages.

Aside from the wrongful death lawsuit the man is now facing, he has also been indicted on two counts of vehicular homicide, and is scheduled to appear in court early next month on those charges.

While this story is very sad, and filing a wrongful death lawsuit will not bring a loved one back, it is a way to hold a driver accountable, and in this case, will also send a message to other negligent drivers who potentially put other people's lives at risk.

Aside from filing this wrongful death lawsuit, the mother/grandmother has also been working with the local chapter of Mothers Against Drunk Driving (MADD) and a billboard of her daughter and grandchild will be put up in the community to help raise awareness about the potential effects of drunk driving.
