Worker injured by semi truck in industrial accident

Industrial accidents caused by falling debris, equipment failure, or other accidents can lead to loss of income and debilitating medical expenses for an injured worker. Employers are obligated to pay workers compensation benefits to injured workers. These benefits include lost income, medical costs and compensation for disability. But sometimes a work injury is caused by the negligence of a party other than the employer, in which case the worker may have other options.

As Maryland workers know, a work place accident can happen even after workers take all the proper safety precautions possible. A recent industrial accident occurred when a man was left trapped between a wall and semi-truck resulting in serious injuries. The worker is in his mid-30s and was helping position a truck for loading when his head was pinned between the loading dock and the back of a semi-truck. He was trapped for a short time before the truck moved and released him. After he was released emergency responders were called in and the worker was transported by helicopter to a local hospital.

News reports did not indicate if the truck driver was employed by the same company as the injured worker. If he was not, but was employed by a different company, the worker may have the option of bringing a personal injury suit against the company that operated the truck. Employers who pay workers' compensation to their employees are immune from a civil personal injury lawsuit, but this immunity does not apply to non-employer third parties. In a personal injury suit, the injured worker can recover additional damages not covered by workers compensation, such as pain and suffering.
