Three-year-old killed in tragic accident

Tragedy can occur when the proper safety precautions are ignored. As Maryland families are frequently reminded, it is always important to wear a seatbelt when driving a car, and it is equally important that children in a vehicle are also properly fastened into appropriately sized and fitted seats. Yet accidents do occur, and a wrongful death can result from the belief that children will be fine as long as they are behind a seatbelt.

A three-year-old girl was killed in a head-on car crash on Monday, and police reported the girl was not properly buckled into her car seat. The girl was riding in a booster seat designed for children between the ages of five and six. A seat of that size was not safe for a child of her size and weight. She died when the car she was in crashed with another car that was turning left. The girl's father was driving the car and was critically injured, and the woman driving the second car sustained moderate injuries.

According to child advocate, the right seat used properly can mean the difference between surviving a crash and tragedy. A seat designed for the child's weight and height can fit a child properly and thus better ensure the child's safety in case of an accident.

In these types of cases, if family members of the child wish to pursue a wrongful death legal action for the loss of a loved one, they would need to prove that the driver was negligent when putting the child in a car seat not designed for the child's age or size.
