DUI/DWI

Silver Spring DUI/DWI Defense Lawyers

Despite intense media attention, rigorous law enforcement and harsh penalties for driving under the influence (DUI) and driving while intoxicated (DWI), drunk driving remains a widespread problem in the Silver Spring area and through Maryland.

It is a big risk to face this serious charge without a lawyer working to protect you from the serious penalties of a DUI conviction. At the Silver Spring law offices of Steven M. Cooper, Chartered, we defend drivers from Maryland and Washington, D.C., as well as drivers passing through the area or here for vacation or business.

Contact a criminal defense lawyer today for a free initial consultation. Let us begin investigating your case. In developing your DUI or DWI defense, our attorneys start with a review of the evidence against you.

  • We investigate the validity of the initial traffic stop. Did the police have probable cause to stop you? If not, any evidence gathered from that point on will be thrown out of court.
  • Were there errors in the administration of the breath or blood tests?
  • Was the testing equipment properly maintained and calibrated?
  • Were the blood samples mishandled?

If the evidence against you is strong, we will make every effort to negotiate reduced charges or alternative sentences.

Defending You in Criminal Court and Administrative Hearings

A DUI is a two-step process and the first step takes place soon after your arrest. Time is of the essence - you only have a short time to request a hearing before the MVA suspends your driver's license for 45 days. We begin preparing your defense immediately by filing a request for a hearing before the Motor Vehicle Administration's Office of Administrative Hearings (OAH).

At the MVA hearing, we learn more about the evidence that will be presented at the criminal case. This helps us prepare for the criminal case that will come to court several months down the road. We also have a chance to get you a temporary license, so you can continue to go to work and school.
